Family law and mediation

Family law is a branch of civil law that governs relations among family members. It covers various legal aspects of family relationships, such as marriage, divorce, child custody, parentage, maintenance obligations, and inheritance.

law and mediation

In the case of family law (marriage contract, civil partnership - PACS, marriage regime changes, adoption, divorce, gifts, partitions, succession), the Notarial office's experience is irreplaceable, and its fields of intervention are numerous.

01

Certified Deed and Family

A deed drawn up, verified and archived by the Notaire, the certified deed provides an extremely high level of legal security.

02

Enduring power of Attorney

Enduring power of attorney, incorporated in the Civil Code by the law of 5 March 2007 concerning the review of legal protection of adults, is a voluntary alternative to legal protection measures which allow any person to anticipate, when illness or age prevents them from protecting their interests, the organisation of their own protection or that of a disabled child.

03

Gift Deed

The gift by hand commonly describes the physical donation of an asset. It can only concern movable furnishings, which can be physically donated by "tradition". In addition, a gift by hand is permitted when it concerns cash amounts donated either by cheque or transfer between accounts.

04

Acknowledgement of Debt

Acknowledgement of debt is the act through which a person, the debtor, acknowledges their debt towards another person, the creditor. It must comply with a certain number of provisions.  The written deed must be dated and signed by the debtor.

05

Mediation

Since 2017, and according to article 6 of Decree number 2022-245 from 25th of February 2022, thanks to a
specialisation course, Mrs Marie Burdet provides mediation services for our clients.

Certified Deed

Regarding family law (marital contract, PACS,change in marital regime, adoption, divorce, donations, divisions, successions, etc.), the expertise of the notarial office is indispensable, covering multiple areas of activity.
A few examples:
The enduring power of attorney is designed to protect your future (this mandate can freely appoint a trustworthy person to represent the client when they are not able to solely manage - for health reasons - their private and property interests); this mandate will prevent an onerous protective measure such as guardianship being implemented.
A manual gift, with considerable consequences, drafted with care, will ensure family peace.
An acknowledgement of debt  in presence of a notary, will provide the lender with greater security.
